NFL makes unsurprising move in wake of Jon Gruden decision

It was expected that the NFL would not take the latest twist in their legal battle against former Las Vegas Raiders head coach Jon Gruden laying down.

On Monday, court documents revealed the NFL is asking for a rehearing of their case in front of the Nevada Supreme Court.

The appeal was submitted in response to the court’s decision in August that the NFL’s closed-door arbitration clause in the league’s constitution did not apply to a former employee like Gruden. Not only that, but the court criticized the NFL for trying to arbitrate matters revolving around their own conduct. The justices deemed it “unconscionable” for the league to invoke the clause, suggesting that their process lacked any sort of transparency or fairness.

Unsatisfied with this ruling, the NFL officially filed their petition for a rehearing.

“In refusing to enforce the clear and unequivocal arbitration provision in the NFL Constitution, the Court committed several errors that threaten arbitration agreements across about of industries,” the petition reads.

“Every sophisticated party that incorporates industry rules or bylaws into a negotiated contract will face uncertainty over whether Nevada courts will honor its choice, while any employee wishing to escape agreed-upon arbitration need only resign before filing suit.”

The league attorneys that filed the petition also argue that the justices were incorrect about the amendment process of the NFL’s constitution, with any changes requiring a three-fourths vote from team owners.

It appears as though the legal drama between Gruden and the NFL will spill over even further, and it remains to be seen what the next step in the battle will be.
